Overview
AmericasVoice.ai respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.
As a news aggregation platform, we provide links to and embed content from various third-party sources. We take copyright claims seriously and will promptly investigate and address any legitimate concerns.
Reporting Copyright Infringement
If you believe that content available on or through AmericasVoice.ai infringes your copyright, please submit a DMCA takedown notice to our designated agent with the information specified below.
Identify the copyrighted work
Describe the copyrighted work you believe is being infringed.
Locate the infringing content
Provide the URL(s) where the infringing material is located on our site.
Provide your contact information
Include your name, address, phone number, and email address.
Include required statements
Add the good faith and perjury statements as required by the DMCA.
Sign and send
Sign (physically or electronically) and send to our DMCA Agent.
DMCA Notice Requirements
To be effective, a DMCA takedown notice must include the following:
Physical or electronic signature
A signature of the copyright owner or authorized agent.
Identification of copyrighted work
Identification of the copyrighted work claimed to have been infringed.
Location of infringing material
Information sufficient to permit us to locate the material (URLs).
Contact information
Your name, address, telephone number, and email address.
Good faith statement
A statement that you have a good faith belief that use of the material is not authorized.
Accuracy statement under penalty of perjury
A statement that the information is accurate and that you are authorized to act on behalf of the copyright owner.
Counter-Notice Procedure
If you believe that content was removed in error or that you have authorization to use the material, you may file a counter-notice. A counter-notice must include:
- Your physical or electronic signature
- Identification of the material that was removed and its location before removal
- A statement under penalty of perjury that you believe the material was removed in error
- Your name, address, and telephone number
- Consent to federal court jurisdiction
Response Timeline
Upon receipt of a valid counter-notice, we will forward it to the original complainant. If we don't receive notice of a filed court action within 10-14 business days, we may restore the removed content.
Repeat Infringers Policy
In accordance with the DMCA, we will terminate the accounts of users who are repeat infringers of copyright. We define a repeat infringer as any user who has been the subject of more than two valid DMCA takedown notices.
Good Faith Requirement
Filing a false DMCA notice is a serious matter. Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages, including costs and attorney's fees.
Before filing a DMCA notice, please consider whether the use of the material may be protected by the fair use doctrine (17 U.S.C. Section 107), which permits limited use of copyrighted material for purposes such as commentary, criticism, news reporting, teaching, scholarship, and research.
